PENYELESAIAN PERJANJIAN KREDIT DENGAN AGUNAN SURAT KEPUTUSAN PNS PADA BANK BRI TERHADAP PIHAK DEBITUR DIPECAT SECARA TIDAK HORMAT (Studi Kasus debitur “M” di Bank BRI KCP Unit Situbondo 2)

Case concerning Debtors guaranteeing Civil Servants (PNS) Decrees at Bank BRI KCP Unit Situbondo 2 but bad credit occurs due to dishonorable dismissal. This is a problem for Bank BRI KCP Unit Situbondo 2 as Creditors. This research formulates the problem of why the Civil Servants Decree (PNS) as a guarantee of credit can be used as a basis for lending by Bank BRI KCP Unit Situbondo 2 and How the actions taken by Bank BRI KCP Unit Situbondo 2 if debtors are fired before repayment is carried out. This study uses a Sociological Jurisdiction approach. Based on the results of this study there is one Debtor who cannot complete the repayment of credit loans because the Debtor is disrespected disrespectfully with the argument of Unlicensed Absence (THTI) Article 86 KUHPM (Military Criminal Law). Bank BRI KCP Unit Situbondo 2 has provided guidance and monitoring in a disciplined manner and sent a Warning Letter and collection directly to the Debtor's house. The conclusion is that the Debtor cannot complete the loan not because he intentionally did not pay off the loan but because he did not have the salary to pay off the loan to Bank BRI KCP Unit Situbondo 2 as the creditor. Suggestions, Creditors are more thorough and disciplined in evaluating prospective Debtors
